The EO's themselves are not that bad. The mental health thing bothers me a little because Eric Holder is a piece of garbage and those being seen as mentally unfit included Tea Party people and other groups who just plain do not like the President.

 

The rumor flying around now is President Obama was forced to change a lot of things Monday before this press conference.

 

He was going to sign an EO similar to Australia's law with FORCED confiscation, but Harry Reid told him he was nuts and going to get impeached.

That would have been an extremely radical step up given the rather subdued list of changes that was ultimately signed. What's the Australian law about? Whose guns are forcibly confiscated?

You are incorrect. Our founding father's made it very clear, to disable tyranny of the majority, that an amendment requires a three fourths vote. Circumventing this process to change rights guaranteed in the constitution is tyranny. Our founders were very clear on what to do with tyranny.

 

Well, there is theory and there is reality. Resisting what they felt was the tyranny of the federal government is what lead to the civil war. We settled the issue. You can't withdraw from the union. You can't nullify federal laws. And as a practical matter, armed resistance to the federal government is anarchy. Look at history. The constitution doesn't say that the courts can review federal laws, yet we have judicial review. Why? Because the court said so and no one argued. As a result it is what we have. The constitution doesn't say that the states can't withdraw from the union, yet the confederate states are still here. Why? Because the union army dragged them back in. I don't think the state of Virginia let a portion of the state secede, but we have West Virginia anyway. Why? Because Congress said so and Virginia was in no position to resist. After over 220 years our recourse against the government is the ballot box. It has worked well for us, The other method may have been envisioned by the founders, but the only time we have tried it, over 600,000 died and the government won. I

Who am I to argue with the bolded? As far as the rest, I didn't hear that. I had my tin foil hat on to block the reception. Could you please tell me how you know that the President was planning to confiscate guns by Executive Order.

On a serious note I really think the part in bold nails it.

 

It's the only argument on the Amendment that makes historical sense to me and it's really the only one that's stood the test of time and has been at the forefront of any discussion over this Amendment that anyone can seem to agree on.

 

Of course, the two groups that always seemed to make those arguments most forcefully were the John Birch Society and the Black Panthers, neither of which are all that appealing to most people. But hey, how often do those two groups agree on anything?
