I have not seen any information on this case other than the link in the initial post, which does not provide any details of the arrest other than the Senator was pulled over for speeding & the officer smelled alcohol. Senator Smith claimed that he did not consume any alcohol that night.

Did you mean other than the .088 on the breathalyzer ? No, no other information other than the legal standard that we judge impairment by.

 

The additional comments are more toward the nature of his defense. His initial attempt was to dredge up some obscure law that had to be dusted off to even be read into record.

 

Yes, everyone is entitled to a trial by a jury of their peers, some are just more entitled than others.
