That's too bad, but probably the right thing according to the law.

As someone was quoted in the article about "Speech is powerful", "It can stir people to action", maybe someone will see to it and take "action".

What bothers me is one of the ways they get their money to travel around all over the country, which I heard was over 200K. About 7 or 8 of the family members are attorneys, and I hear they are kind of good, the people in and around Topeka says they hate them and can't stand them either, but they also say if they are in need of an attorney they will go to them. They can't be like a dream team type of law firm, the people in Kansas can find other good attorneys and not give this hate group money to fuel their hate!

The other way they get money is if a community tells them they cannot protest then they will sue, after they prove their 1st Amendment Rights were violated they usually get around 10K for their attorney fees.

I guess this Court isn't as conservative as many would want you to believe.

No, from a legal perspective this is actually a very conservative decision. I'm actually somewhat surprised in Alito's dissent.

Question, could a town or city still pass and enforce an ordinance not allowing protest with in a certain distance of a cemetery?

Protecting 1st amendment rights is actually a very conservative ideal, or at least it used to be.

They could PASS and enforce anything. Whether or not it would hold in a court of law is a question best left up to a greater legal mind than myself.

I am not saying the decision is right or wrong, but while it protects the rights of these loons to yell hateful crap at people, it does not fully protect the rights of those in grieving.

This is the price we have to pay for the right to free speech in this country ... even if we feel that Westboro's actions are despicable and tasteless, they are entitled to voice their opinion.
