The mother of a man who police said attempted to rob a Starbucks in California, but was thwarted by a Good Samaritan, reportedly said her son plans to sue because the hero used "excessive force."

 

The video of the July robbery went viral. Police released the footage showing Cregg Jerri, 58, struggling with a would-be robber in a Transformers mask who tried to stage a hold-up with a knife and toy gun at a Starbucks in Fresno.

 

Jerri, at one point, approaches the robber from behind and bashes him over the head with a chair. Eventually the two hit the ground and grapple. Police said Jerri was stabbed in the neck as he tried to grab the knife.

 

They said when Jerri took the knife away, he stabbed the robber several times. Police said Ryan Flores, 30, was the man in the mask.

 

"The guy, in my opinion, went from a Good Samaritan to a vigilante," Pamela Chimienti, Flores’ mother, told KSEE-TV. "Stabbing somebody that many times, it doesn't take that many stab wounds to get somebody to succumb to you."

Basically if you don't want to watch the video...guy comes in wearing a mask and waving a gun, goes to the counter and threatens the cashiers and then pulls out a knife and waves it and the gun. Old guy come up from behind and cracks him with a chair and and they fight. Old guy gets stabbed in the neck then takes the knife and strikes robber several times with the knife. Now the robber's mother is saying they may sue him for excessive use of force.

Interesting situation, legally speaking. California's Good Samaritan laws only apply to individuals rendering medical aid, so they wouldn't apply to Mr. Jerri in this situation.

In the flipside, they apparently don't have any laws applying to vigilantism.

His argument could be that he was stabbing a guy that had just displayed a gun to subdue him. I lost track of where the gun went during that melee, that could be his best claim of self defense.

What is crazy is that if he had just shot the guy, there would be no questioning his actions since the robber was pointing a gun and knife at the cashier.

The fact that the robber had a knife makes this a felony, doesn't it?

So the customer uses a chair to try to stop a felony, then is attacked with the knife. Sounds like attempted murder to me. And if he didn't know the gun wasn't real, there's no way you can prove the old guy wasn't afraid for his life.

Even in California, surely to goodness this is still a slam-dunk, no-brainer.

Nevermind...California self defense laws cover individuals acting in defense of others when there is reason to believe another's safety is in question.

PEOPLE! Quit calling him an old guy! He is a mature hero...and younger than I am.

In the heat of the moment and a guy stabs you, I would think it doesn't matter how many times you stab him back to subdue him.

I would hope that Starbucks would give this mature hero all the legal help he might need.
