    Could gambling be legal in all 50 States soon?

    On Tuesday, the U.S. Supreme Court agreed to hear a case that challenges the federal prohibition on expanded betting on sporting events. The case, arising from efforts by New Jersey to enact sports wagering, will be presented as early as October 2017, with a decision coming in the weeks or months thereafter.

    While the decision doesnít mean New Jersey will win, itís an encouraging sign. New Jersey had lost at every step of the process, and a decision by the Supreme Court not to hear the case would have ended it with an ďLĒ for pro-gambling interests. A victory remains possible, and some will predict that the current makeup of the Supreme Court points to a win.

    The argument against the law flows from the notion that states should be permitted to decide whether to allow gambling on sports. The 1992 law was written in a way that allowed places like Nevada to continue to permit sports wagering, forbidding other states who didnít already allow this form of gambling to join in.

    I walk across the street and buy a beer all the time. If they added sports betting and boiled peanuts, I would live at the store and walk home to sleep.

    If we are talking from a legal stand point then I don't think the Federal government should discriminate between states.

    I'd like to hear the argument against legalizing it.

    I'm trying to come up with a possible rationale as to why it should remain illegal and I just can't find it.

    If I remember correctly, the 1992 law included exceptions for states that had previously allowed sports gambling. NJ missed a deadline to apply for its exemption and was thus barred from later legalizing gambling. I'll be interested in this case, but imagine the ruling will be narrow and focused on NJ.

    Anyone remember when the Kentucky Lottery was starting, there was going to be a weekly "Pro Football Contest" where you would pick which city would beat another city in that weeks Professional Football competition A line would be set and you would be selecting picking against the spread. I remember picking up a pamphlet at the local convenience store that explained how it would work and had a sample pick sheet in it.

    At the last minute the NFL got involved and sued or threatened legal action and the "Pro Football Contest" sadly went away at the last minute just before the season was to start.
